10/17/09 Board Meeting Minutes Summary

Total present was 14 - 8 board members, 6 residents and Metcalf.

Minutes of the 9/19/09 Board Meeting were approved.

Motion to pay bills in the amount of $2,463.12 was approved.

NEIGHBORHOOD WATCH PROGRAM: There are currently 14 volunteers and a meeting should be scheduled this month.

4th QUARTER NEWSLETTER: Please forward your birthdays, anniversaries, prayer requests and articles for the newsletter this week for publication.

LANDSCAPING: Fall planting of the front entrance will take place the end of October.

PAVEMENT UPDATE: On October 7, 2009 the Birmingham News published an article regarding our pavement dilemma. Pinson’s Mayor continues to work on this issue which is currently before the City of Pinson for resolution.

LIENS: Metcalf has placed 36 liens against properties and letters have been sent. All liens must be paid in full. There is no payment plan for delinquent portions.

2010 BUDGET: The 2010 budget and financial status were presented. A copy will soon be forwarded to the property owners with their 2010 Association Dues invoices. There will be no increase in dues, however, there will be an increase of $20.00 if paid in installments. Dues are delinquent if not paid in full by February 1, 2010.

METCALF REALTY: Heather Pointe is renewing our contract with Metcalf for 2010 with no changes to our current contract. Metcalf has agreed to pay all costs incurred to record the contract at the courthouse.

Metcalf stated from day one we have shown improvements. From August to October there were 16 violation letters sent with two outstanding for satellite and window treatment. The focus is not on fees, but on compliance with our community’s rules and regulations.

September 19, 2009 Board Meeting Minutes Summary

Total Present: 13 – 8 board members, 5 residents. Metcalf was not present.

Minutes: The August 15, 2009 Board Meeting Minutes were approved.

Bills: Motion to pay bills in the amount of $2,440.35 was approved.

Signs: The NO SOLICITING, LOITERING, TRESPASSING sign has been installed.

News Letter: The 4th Quarter News Letter is currently under development. Email all submissions for publication to heatherpointe@gmail.com.

Neighborhood Watch Program: Lakesha and Holly are heading our Neighborhood Watch Program. There are 14 volunteers, but more are needed. After speaking with the Jefferson County Sheriff’s Department, Holly and Lakesha will present a plan at the October meeting. To become involved email heatherpointe@gmail.com .

Landscaping Committee: Volunteers are needed. Email heatherpointe@gmail.com if you can help.

Pavement Issue: Mayor Sanders has placed the pavement issue of our community before the Pinson City Counsel as Resolution #09-21.

Homeowner Association Dues: Current outstanding dues are $8,075.52. The Executive Board is signing off for liens to be placed on those properties.

Business and Discussion of Concerns: Professionalism on the part of Metcalf and the Board in dealing with the residents, site inspections, robbery in the 5900 block of Princess, dogs running loose, broken curb, vehicle parking obstructing the flow of traffic, pot-holes in the streets, junk cars parked at residences and mildewed siding.

Lakesha reported residents have shown a greater community awareness and have called the police when things seemed suspicious. In one such incident, five people called the police who responded within two minutes.

The Board will begin to think of ideas to generate income, such as, a Community Garage Sale or a Block Party.

The 2010 budget will be presented at the October meeting.

July 18, 2009 Board Meeting Minutes Summary

Total Present: 13 – 7 board members, 5 residents. Metcalf was not present.

Minutes: The June 20, 2009 Board Meeting Minutes were approved.

Bills: Motion to pay bills in the amount of $2,148.88 was approved.

June, 2009 Beautification Award: Harry and Vanessa Wakefield of 6037 Princess Boulevard.

Signs: The NO SOLICITING, LOITERING, TRESPASSING sign has been purchased. We need someone to install this sign at the front entrance. The Board is continuing its efforts to work with the City of Pinson regarding Speed and Litter Signs.

News Letter: The 3rd Quarter News Letter, scheduled for delivery on August 15th, is currently under development so please hurry and email all submissions for publication to heatherpointe@gmail.com.

Neighborhood Watch Program: A volunteer is needed to take over. The Police are willing to train the committee. To volunteer or join, please email heatherpointe@gmail.com.

Landscaping Committee: Many thanks to everyone who has done site inspections, provided input for the Beautification Awards, picked up trash and/or helped maintain our front entrance. Volunteers are still needed! There is an urgent need for volunteers to help maintain the entrance for the month of August. Email heatherpointe@gmail.com.

Pavement Issue: The Board was reminded of the six year statute of limitation and discussions ensued regarding possible means for resolving the pavement issue since developer John Millington has yet to provide the bonds/CD and Letter of Release to the Jefferson County Roads and Traffic Department. The Board will continue its efforts to resolve this issue.

Homeowner Association Dues: Currently there are 55 homes with outstanding dues. The Board will begin accessing liens following the August 15 meeting.

Additional Rules and Regulation Amendments Added:

Section 6.7

G. Directional for Sale Signs are prohibited on streets in the Heather Pointe Community. For Sale signs are only allowed on seller’s property which must be professional signs not more than six square feet.
H. Yard and/or Garage Sales (1) Yard Sale and/or Garage Sales are not to be conducted as a business; (2) All signs associated with yard and/or garage sale must be removed immediately after completion of the sale; and (3) No more than four sales, one each season, not exceeding three days are allowed.

6/20/09 Board Meeting Minutes Summary

Total Present: 20 - 8 board members, 11 residents and Metcalf.

Minutes: 4/18/2009 Board Meeting Minutes was approved.

Bills: Motion to pay bills in the amount of $6,344.57 was approved.

May, 2009 Beautification Award: Congratulations Bill and Jean Murray - 5846 Princess Blvd.

Board Approvals (Feb. - May, 2009): Fence, security door, patio addition and storage building.

Signs: The Board has selected a sign to be purchased in the amount of $42.55 which states NO SOLICITING, LOITERING, TRESPASSING.

Mayor Sanders advises speed signs cannot be placed as our roads have not been finalized. He will check into a Litter Sign to be placed on the road just prior to entering Heather Pointe.

News Letters: 2nd Quarter News Letter was developed, issued and delivered by Gloria Vail. 3rd Quarter News Letter is scheduled for delivery on 8/15/09. The main purposes of the News Letter are to keep us informed regarding our neighborhood, promote community involvement and encourage everyone to get to know their neighbors.

Flyers Announcing June Board Meeting: Delivered by Veronica Jackson.

Pavement Issue: The Board continues to work to resolve the pavement issue. Developer John Millington is to provide the bonds/CD issued by Compass Bank along with a Letter of Release to Tracy Pate of the Jefferson County Roads and Traffic Department who currently have no record of the bonds/CD. Ms. Pate has provided Mr. Millington with her contact information and has offered to meet Mr. Millington at the bank. The Board will continue to follow up with Tracy Pate on a monthly basis.

Violations: Metcalf to provide list of homes having received violation notices which have not complied. Metcalf inspects weekly or bi-monthly. Current common violations are overgrown grass, swing, satellite dishes and fences. The Board inspects on a weekly basis for overgrown grass, siding, garbage cans visible from the street, parking, blinds or window treatments and appearance of front of property.

Procedure for Reporting Violations: Email heatherpointe@gmail.com. Include violation, house number, date, time and picture. If road and/or parking violation, then provide violation, make, model, color and license plate number.

Speeding: Neighborhood speed limits are 15 - 25 MPH. Sheriffs have pulled people over in our development for exceeding the speed limit.

Solicitation: The City of Pinson has no solicitation ordinance. Everyone coming into our neighborhood must have a Pinson City Business License. Ask to see their license. If they don't have one, report them providing the business name, address, phone number, contact person, etc.

Homeowner Association Dues: Final Notices were sent on 5/4/09. Metcalf provided an updated list of unpaid dues. Homeowners with delinquent accounts should immediately contact Metcalf to make (and keep) arrangements on arrearage balances. The Board will decide at the August 15, 2009 meeting against which homes liens will be placed.

No Directional for Sale Signs (Signs not in homeowner's yard) : A motion was made and carried to add to our Rules and Regulations.

Yard Sales: Yard sales are not to be conducted as a business or be too frequent. Signs are to be removed immediately following the sale. Duration to be decided upon.

Landscaping Committee: Detail Services maintains the front entrance on an every other week basis. Volunteers are needed to weed and pick up trash the rest of the time. To join this committee please email cahalderman@yahoo.com.

Neighborhood Watch Program: The first meeting is to be held by the end of July. Please email heatherpointe@gmail.com if you are interested in joining.

Burglaries: There have been approximately 13 home break-ins since November, 2008. Daytime robberies carry a lesser sentence. This month, two were apprehended as the result of a neighbor calling the sheriff to report seeing two guys at a neighbor's home who was at work at the time of the robbery. Their hearing is scheduled June 30, 2009. If you have been a victim of a break-in and evidence was collected at the time of the incident, please email your information to cahalderman@yahoo.com.

Front Entrance Sprinkler System: The sprinkler has been fixed thanks to our President, Liz, who wears many hats.

Outcome of votes for Metcalf Realty, Inc to Manage our Covenants - 133 yes votes
Metcalf Realty, Inc is mailing out letter and the 2009 invoice statement.

Street Lights - work order per AL Power Co for Monday 2-2-09.

News Letter and Covenant to be delivered February 14, 2009.

I, Liz Reiff, would like to thank everyone in the community for their patience while we establish a working Board and relationship with Metcalf Realty, Inc. Please be aware of what is going on in your community and look out for each other. There has been many unwanted individuals in our neighborhood performing illegal activities to our homes. This needs to be stopped and one way to help prevent this is for all of us to become more vigilant. A suggestion has been made for all residents to turn their side flood lights on during the night to keep the dark part of our homes lit up to deter these unwanted individuals. Don't forget to turn them off in the day time!
