City of Pinson Zoning Board

The City of Pinson will be taking over Zoning January 1, 2012. As part of that process, They will need a Board of Zoning Adjustments. This body hears and appeals on special variances related to zoning or setbacks. They meet on an as-needed basis.

Attendees signed in and received a copy of the agenda and finances for July-October 2011.

The Heather Pointe Homeowners Association (HOA) meeting was called to order by the President, Liz Reiff at 9:00am. Invocation and roll call was also done the President. In attendance were Liz Reiff- President, Sylvia McClain- Secretary, Elaine Perry-Treasurer, and Sabrina Gaddy- Metcalf Realty Co. Representative.

A motion to waive the reading of the minutes and approve as written from the June 18, 2011 meeting was made by Sylvia McClain and seconded by Elaine Perry. The motion passed.

Treasurer, Elaine Perry made a motion that the amount of $10,248.67 be paid for bills incurred from July 2011 through October 2011. The motion was seconded by Sylvia McClain. The motion passed.

Sylvia McClain gave a report on National Night Out stating that the event was a success. Pinson’s Mayor Sanders as well as Councilor Churchwell were in attendance. The Pinson City Councill furnished refreshments for the event. Other public service organizations making an appearance were Center Point Fire and Rescue and The Sheriff’s Department. Adults, children and pets met other neighbors in the Heather Pointe community. For a first time event NNO was a success.

In old business, 37 liens were placed on April 11, 2011 and 20 in July 2011

Elaine Perry stated that Metcalf has done a good job and that she is pleased with the outcome. She further stated that she did not move to Heather Pointe to live in a slum and that other occupants need to step up and lend a hand in overseeing the HOA. Without any leadership the community is destined to fall into decline. She was adamant about the possibility of the street lights stating that this is when many break-ins in the past occurred and break-ins tend to increase during holiday seasons.

Liz Reiff stated that if there is no money to pay for lights then Alabama Power will automatically turn them out.

Further, if Heather Pointe is to continue as a community without the ravages of neglect and depreciation of property values dues will need to be paid and new board members will need to step forward. The present board has stated that they will no longer serve at the end of 2011. Consenting to pay association dues yearly was part of the contract homeowners signed when closing on their homes. Paying HOA dues is not an option but a legal binding.

Liz Reiff stated that the lights on either side of the front entrance tend to go out when there is a heavy rain.

Sylvia McClain canvassed several plumbing companies to obtain the best estimate for back flow testing. The best estimate was given by John’s Plumbing at $125. Back flow testing  by a certified plumber is required by Birmingham Water Works each year. Sylvia also suggested sending out an e-mail to all residents asking if there is a certified plumber living in the community who could do this free of charge.

The contract with Metcalf Realty Co. is up in January of 2012. Metcalf has done much pro bono.

Liz Reiff said that she was grateful to those who had paid their dues and asked that those attending circulate the need for new officers for 2012.

Resident comments and concerns included:

1. Are the homes that are up for auction bringing down the home values of others in the community? The answer was yes, from Sabrina Gaddy. She further stated that if a good price is not achieved at the auction, auctioneers will reschedule the auction but not make that knowledge public.

2. The brown dog that belongs to the residents at 103 St. John Rd. is a nuisance, tearing open garbage, chasing children. Residents should call make complaints to the Pinson City Hall regarding the dog and also attend Council meetings and voice concerns.

3. The common area that backs the homes on the highway 75 side can be purchased but everyone on that side of the street would have to be in accord about it and purchase it. Extending a privacy fence beyond his legal property line is not advised. To extend a fence beyond legal boundaries could result in legalities later because that property does not belong to the property owner.

4. A concern was voiced about the home on St. John that allows garbage to collect without disposing of it.

5. Neighbor has high grass.

6. How many homes have liens?

7. What can we do to let people know they are needed to serve on the board?



A motion to adjourn the meeting was made by Sylvia McClain and seconded by Liz Reiff. The meeting was adjourned at 9:45 am

OCTOBER 2011

Happy Anniversary!
It was at this time last year Heather Pointe president Liz Reiff's intense and tireless campaign to have the streets of Heather Pointe paved became a reality.   Within months the streets of Heather Pointe were smooth and free of potholes. I'm sure we all appreciate her hard work and smooth driving!  


UpdateThe Hot and Cold beverage store either didn’t close or is open under new management. I went by the business this past week and asked the people behind the counter if they would be closing. I related to them the information I was led to believe at the September Pinson City Council meeting. Both of the clerks there stated that they had not heard about a closing. The September 2011 minutes have not been placed on the City of Pinson website so I am unable at this time to check the facts. As of this date the Hot and Cold beverage store remains up and running.


The annual Veteran’s luncheon will be held November 10th at Pinson United Methodist Church. Veteran’s should call Pinson City Hall to reserve a place at the luncheon. Ask for the time of the luncheon when you phone City Hall. 205-680-5556

The City of Pinson has received repeated requests for a park with playground equipment and walking trails. The mayor has been looking into an area with 14 acres at a price of $180,000 for this future venture.

Dollar General now has an off premise alcohol license.
911  Exercise the Neighborhood Watch program.  The National Night Out event held in August was to  allow us to meet our neighbors and show our unity in the fight against crime. Stay aware of your surroundings and those of your neighbors. Report any  suspicious activity and unfamiliar cars, trucks and persons coming onto our streets to the Sheriff's Department. Better to be safe than sorry.

Annual Butter Bean Festival

The Pinson Butter Bean Festival was held for two days this year, September 2nd and 3rd on Main Street. Friday’s activities  began at 6:30 pm with the last event for the evening set to begin at 8:30 p.m. Saturday’s festival hours were from 8:30 am until 2:30pm.

Pinson holds the record for the largest amount of butter beans cooked at one time. An official from the Guiness book of records was on hand to present a certificate for this feat at the 2010 festival.

Activities this year  included numerous stage bands and singers, greased pig contest, dog tail wagging contest, antique car show, butter bean and cornbread cooking contest and much more.

The Hot -n- Cold package store next to Food Giant has closed. It is being replaced with and ABC  (Alcoholic Beverage Control) store.

A recycling station is scheduled for set up at the rear of Pinson City Hall some time this year.

Highlights from
National Night Out
Residents of Heather Pointe turned out this past Tuesday, August 2nd for  it's first National Night  Out. Although the heat was sweltering a good number of families supported NNO.
In attendance were the Mayor of Pinson, Hoyt Sanders (left) along with Deputy Jeff Hannah (right). The Mayor exhibited his culinary skills, arriving with grilled hot dogs for the event. Additionally, the City of Pinson also provided sodas, chips and frozen fruit bars. Councilor John Churchwell stopped by for a hot dog and visited with neighbors.
Fire Marshall, Matt Angelo (left) and other members of the Center Point Fire Department were on hand as well.

Pets are usually good icebreakers for children. Children showed quite a fascination and no fear for the two Great Danes in attendance with their pet parents.


New found friendships were formed among children and

adults.



 


Thanks go out to the City of Pinson for choosing Heather Pointe as one of the anchor communities for NNO. Thank you to the neighbors who loaned coolers and other needed items. Though not listed many neighbors thought to bring fans and chairs.

“NNO has proven to be an effective, inexpensive and enjoyable program to promote neighborhood spirit and police-community partnerships in our fight for a safer nation.”

Headquarters for NNO in Heather Pointe will be in the driveway and garage at 5781 Princess Blvd.  We look forward to seeing you at this  outdoor event. This will be a great time to take a walk in your community and meet other residents of Heather Pointe.


Pinson City Council representatives will have hotdogs and soda pop. Neighbors may bring additional food to share with others. Show your unity in taking a bite out of crime.

National Night Out

Innsbrooke and Heather Pointe will be two of the featured communities during the  August 2, 2011 National Night Out.  As NNO goes into its 28th year it provides a wonderful opportunity for neighborhoods to show unity in the fight against crime. 
According to the NNO website, NNO is intended to;
  •  Heighten crime and drug prevention awareness;
    • Generate support for, and participation in, local anticrime programs;
    • Strengthen neighborhood spirit and police-community partnerships; and
  •  Send a message to criminals letting them know that neighborhoods are organized and fighting back.
With the recent posting of the Neighborhood Watch signs this event will strengthen the vitality of the program.

Mayor Hoyt Sanders and the City of Pinson will provide refreshments for the community at a designated home to be announced later. Residents may also contribute refreshments if they like. The tentative time slot is 6:00-8:00 pm on August 2nd.


To ensure clear access to roads, we would like to request that you walk to the designated NNO home if you are able. What better way to end the day than with an evening walk socializing with neighbors and bonding to fight crime.


Beat the Heat at Turkey Creek

July 16, 2011 from 10:00am-2:00pm. Pinson city leaders will be doling out cool confections to those present at Turkey Creek.

Heather Pointe Homeowner’s Association Meeting

Attendees signed in and received a copy of the agenda and finances for April-June 2011.

The meeting was called to order with an invocation by HOA president, Liz Reiff. Roll call by the president included board members, Liz Reiff and Sylvia McClain. The president reviewed the protocol for the meeting.

A motion to waive the reading of the minutes frrom the March 26, 2011 meeting and approve as written, was made by Sylvia McClain. The motion was seconded by Liz Reiff.

The president motioned that the bills for April-June 2011 in the amount of $7,494.29 be paid. The motion was seconded by Sylvia McClain.

Thanks again went out to Bill Murray for installing the Neighborhood Watch signs. Contact the sheriff’s office if there are problems in the neighborhood. Contacting the HOA will allow us to make the community aware of problems. The more who are aware of situations will help make more be observant.

Bill Murray has consented to water the front entrance flowers. The sprinkler system is operated manually because the water constantly runs even when the irrigation system is turned off. Bill consulted with another neighbor who has experience in landscaping. The neighbor found the problem to be a valve that needs to be replaced. Estimates will be looked into for repair of the valve and mulch to maintain moistness and improve appearance.

Of the 37 liens placed in April 2011, two have paid overdue association dues. Five violation letters were sent out regarding trash cans and holiday lights. 29 homes will have liens placed due to unpaid dues. Liens will be removed from two homes

All HOA board positions remain open for 2012.

The next quarterly meeting will be some time in September and the annual meeting in October. The two meetings may be combined. Details will be announced at a later date with residents receiving e-mail and flyers.

Sabrina Gaddy of Metcalf Realty reported that the new residents on St. John whose dues were not paid by the closing attorney will have them paid at the attorney’s expense. People who have called her regarding lawn service have received the name and number of Ignacia Vega who lives in the community.

Resident comments included:

• Princess Blvd. residents complaining of two, brown loose dogs. The residents stated that one of the dogs is aggressive. Residents should call the City of Pinson with complaints and other government officials who deal with this type of problem.

• Neighbors who leave sales papers and trash cans unattended on their property create an eyesore and an invitation to criminals. If a home is empty it was suggested that adjoining residents pick up flyers and papers so that the property won’t look abandoned. Several empty homes have already had AC/heating units vandalized.

• A written complaint about barking dogs was made by a resident but no address for the dog owner was given.

Seven residents attended this HOA meeting.

A motion to adjourn the meeting was made by Sylvia McClain with Liz Reiff seconding. The meeting was adjourned at 9:45am.

MAY 2011

The  devastating April tornadoes spared  the Heather Pointe community. Yet many were the recipients of destructive remnants left by the tornadoes. No doubt  someone you know was  affected in some way. The EMA of Alabama and those connected with search and rescue operations have done a tremendous job.  Perhaps you have sheltered loved ones who have lost their home, assisted with cleanup or donated time and supplies. You too are a hero/heroine. Let us not forget those who perished, those who were injured  and those in need.  
* Summer is fast approaching.  Children will be spending more time out of doors. The carefree lives of most children causes them to sometimes become careless. An out of bounds ball, bicycle or  running child can appear out of nowhere.  Stay alert and pay attention to speed limit signs.

MOVIES IN THE PARK


The City of Pinson will sponsor outdoor movies on May 13 and May 20. The field behind Solid Rock Church is where the movies will be shown. Bring your lawn chairs beach towels and snacks. Movies start at dusk. Pinson Methodist Church will be the alternate site in case of rain. The movies are free and fun for the whole family.

Heather Pointe Homeowners Association

The Heather Pointe HOA met at the Pinson Community Center on March 26, 2011, at 9:00a.m.

Invocation was given by the President, Liz Reiff.

Roll call by the Secretary, Sylvia P. McClain. In attendance were Liz Reiff, President, Sylvia McClain, Secretary, Elaine Perry, Treasurer and Sabrina Gaddy, Metcalf Realty representative. Fourteen residents of Heather Pointe were also present.

The President gave the protocol for the meeting.

A motion was made by the Sylvia McClain to waive the reading of the October 23, 2010 minutes and approve as written. The motion was seconded by Elaine Perry. The motion carried.

The Treasurer read the amount for bills incurred from November 2010 to February 2011. The amount totaled $12,151.34. Motion was made by Elaine Perry to pay the listed amount. The motion was seconded by Sylvia McClain. The motion carried.

The President stated that there are three Neighborhood Watch signs received from the City of Pinson that need to be installed. The signs did not include the hardware necessary to hang them. She will purchase the hardware and have the signs hung in three strategic places. There are several neighbors who have been discreetly observing the happenings in the community.

August 2, 2011 is National Night Out. The City of Pinson will be a part of observing this event. Several communities will be involved. The Mayor of Pinson has asked if Heather Pointe would like to participate. Sylvia P. McClain has volunteered to represent Heather Pointe. Anyone who would like to be a part of this worthwhile national program should contact heatherpointe@gmail.com

The front entrance lights have been repaired. The sprinkler system needs to be fixed. Spring flowers will be planted in the future. Anyone willing to be a part of the Landscaping Committee should contact heatherpointe@gmail.com

Liens from 2010 were removed from the homes of those who had satisfied their monetary obligations. The community avoided the charge of an electrician for the repair of the entrance lights on the left side. The repair person did not charge a fee because the problem was a minor one. The sprinkler timer is not working and the watering system has to be operated manually. Estimates will be sought for sprinkler repair. Three nomination forms were received. One was ineligible to hold an office on the HOA board because he is not a homeowner but, he is eligible to serve on any committee. The other two will be sitting on the board if they agree to it to take over the 2011Vice President’s seat and the 2012 President’s seat. Nominees were encouraged to shadow the HOA activities of officers to get a feel for how the position is run. The President stated that her duties are minimal with Metcalf handling the more involved details. She further stated that she has been president for three years and is ready to surrender the position but will continue to work in a different capacity.

The 2012 Secretary and Treasurer seats will be open.
43 liens will be placed in 2011. A second dues late letter will be sent to residents who are in noncompliance. Five violation letters went out in regards to trash cans in sight from the street and Christmas/holiday decorations still on exhibit.

HOA meetings are held quarterly. The next meeting will take place in June.  The time and place will be announced at a later date.

Sabrina Gaddy, Metcalf Realty stated that she does on site inspections every other week or once a month. If residents having additonal complaints, they must be placed in writing and either e-mailed to the Heather Pointe address or USP mailed to the Heather Pointe PO Box. Verbal complaints will not be addressed. The amount of insurance paid for the common areas and officers was $1200. Heather Pointe has $18,159,57 in treasury. Amenities such as lights, landscaping, and other services that enhance the community will be cut if delinquent residents do not pay their dues.

Resident Comments

Vanessa Cotton stated that there have been some break- ins in cars and houses on Caylan. Residents are urged to attend Pinson City Council meetings to tell the government you need more police patrols. The more people who attend and speak out the more action you will receive.

Barbara Lewis stated that two of the vacant houses near her have had their back doors kicked in. She says that she picks up sales papers and flyers that are at empty properties to discourage break ins. Residents who leave sales papers, trash cans and other debris outside the home advertise that they are not home.

Bill Murray wanted to know what would happen once the finances go in the hole.
Lights, would first be turned off leaving Heather Pointe in the dark as it did about 3-4 years back.

The President stated that consideration of Thanksgiving, Christmas, fire dues and property taxes being a part of the latter part of the year, February was the month decided upon.

The Brooks’ are a new family in Heather Pointe. Tamir Brooks had several questions. Among them were; if mailboxes were to be alike because his was not. He also asked about the lawn and whether or not the grass must be kept a certain height. Also, he asked and was given information about Veolia waste management service along with pick up dates. Tamir Brooks stated that he installs ADT security systems and is a licensed electrician.

Barbara Lewis asked about the community having a yard sale.
The HOA Secretary told her of how a particular date was decided upon and how a past HOA officer had an advertisement placed in The Birmingham News and other communicative sources. If Ms. Lewis would like to organize a community yard sale, she should submit her plan in writing to the board for approval. An organized sale at a set time would give occupants time to organize their sales items, plan for increased traffic flow and thwart haphazard yard sales causing undue stress on neighbors.

Barbara Lewis asked if anyone had had HVAC problems.
Many residents in Phase I of Heather Pointe stated that they’d had problems. Phases I and II of Heather Pointe were built by American Land and Homes with Phase III being built by D.R. Horton. Carol Halderman says that she has her HVAC unit checked twice a year by a company she trusts and has been pleased with the results.

Ms. Halderman also said that last year she bought the wrong type of fertilizer which injured her lawn. It has since been reseeded and she will need to wait a while before she cuts it so it will look shaggy for a bit.
President, Liz Reiff thanked Carol for letting the board know ahead of time. She reiterated the need of residents to communicate with the board regarding special circumstances. The board does not want to know intimate details but if a person is having legitimate difficulties paying dues, having the yard mowed, taking down holiday decorations they should contact the board. Otherwise, these acts will be considered violations to the Heather Pointe Covenant et.al. and will be handled accordingly.

Shirley Naylor stated that she needs a reliable person to cut her grass. She was given the name of a Heather Pointe resident.

Janae Vail asked if we could paint our mailboxes? She stated that the posting of flyers with tape pulls the paint off of the mailboxes. HOA stated that mailboxes may be painted as long as they are black. Two HOA members confessed that they have used tape before but no longer use it to secure flyers. Flyers are now either stapled or tucked behind the red flag on the box.

It was moved by Sylvia P. McClain to adjourn the meeting and seconded by Elaine Perry. The meeting was adjourned at 10:15 a.m.
