MAY 2014

THERE HAVE BEEN REPORTS OF DOGS roaming  the Heather Pointe neighborhood

Under the direction of the Board, it has been recently reported and observed
there are several dogs roaming the neighborhood unleashed and unattended by
their owner(s).

This is not only a violation of Heather Pointe's documents concerning "Pets"
but also a violation of the City of Birmingham's Leash Law (Code #6-1-14) as well as the City of Pinson and surrounding areas.

The Rules and Regulations that govern Heather Pointe are clear when it comes
to matters of this nature and states,
"1. All pets must be on a leash.
  2. Pets to be walked on street only, owner must pick up the animals waste from neighbors lawn or  street."

In addition, the City of Birmingham's Leash Law (Code #6-1-14) as well as the City of Pinson and surrounding areas, requires all
dogs be on a leash while in any public area.  You must have complete control
at all times.  This is for everyone's safety.  Please be advised if your dog
does bite someone or causes any other type destruction, you as the owner are
legally liable.  In some instances, the law requires the dog be quarantined
at owner's expense, a report filed with the Health Department and legal
officials, and the result may be you having to put your dog to sleep and
also pay all medical and repair bills.

Please be advised, if roaming dogs continue to be a problem in the
neighborhood the Sheriff's Department will be contacted whereas traps may be
set to catch and impound the dog(s).  Of course, we hope this will not be
necessary.

Please comply immediately by leashing your dog at all times they are outside
of your home and in a public area.

See the information in the sidebar on  how you may contact Animal Control .

Thank you for your attention to this matter, and if you have any questions,
please do not hesitate to let me know at 205-879-2177 ext 215.

Please know that the Board and Metcalf Realty, Inc. strive to maintain and
improve the property to insure continued appreciation.

A new Heather Pointe board was elected for 2014. As with any new endeavor, it takes time to become acclimated to the duties.

The Board is in the process of working on making the front entrance more inviting and attractive. The lights have already been repaired and final decisions on estimates from  landscaping  companies are being made. Rose bushes along with some other blooming flowers for the entrance have been considered. Before anything can be planted the irrigation system must be repaired.  Without proper irrigation already in place anything planted would die. Plans also include having an irrigation timer installed to avoid unnecessary watering.  Once planting and irrigation means take place, the beds will be covered with pine straw to maintain moisture.
